On Mondays, Rogan’s List features a listing of proposed rule and regulation changes that are currently accepting public comment.  Commenting is the way to show government agencies how we feel about these proposed changes. Our comments also become part of a record that will be reviewed by courts if and when a reg change is contested. Courts use comments to judge whether an agency is acting arbitrarily and capriciously.

CORONAVIRUS LEGISLATION:  “Earlier this month, Trump signed into law a $8 billion in coronavirus response package, the first congressional measure to address the coronavirus. It boosted funding for testing of the virus and lower costs for related medical treatments.”  “The economic relief bill [the House bill passed by the Senate yesterday] marks the second such aid package in a matter of weeks. The legislation passed Wednesday provides paid sick and family leave for some for U.S. workers impacted by the illness, expands unemployment assistance, includes nutrition assistance and increases resources for testing. INSIST ON RAMPING UP VENTILATOR PRODUCTION NOW TO COMBAT COVID-19: Today Trump invoked the National Defense Authorization Act, which will ramp up industry to manufacture ventilators and other necessary medical equipment. https://www.usatoday.com/story/news/politics/2020/03/18/coronavirus-what-defense-production-act-trump-has-invoked/2865598001/. However, it’s not clear how much will be produced and why this wasn’t done earlier. This article in Forbes Magazine talks about how industry could easily produce five times the number of ventilators that are currently produced. Let’s express our concerns to our MoCs and ask them how they can help assure that the maximum number of ventilators and medical supplies will be produced as quickly as possible.

DEMAND THAT ICE STOP ARRESTING AND DETAINING PEOPLE DURING CORONAVIRUS LOCKDOWN: Even though several California counties are in shelter-in-place status and the whole country is hunkering down to maintain physical distance and restrict all non-essential activities, ICE is continuing business as usual in LA, arresting both undocumented residents and green card holders who have committed crimes. https://www.latimes.com/california/story/2020-03-17/for-ice-agents-its-business-as-unusual-day-after-sweeping-coronavirus-order. Let’s also ask our MoCs to introduce legislation to stop or severely restrict eligibility for arrest and deportation during this crisis.   

STOP REFERRING TO COVID-19 AS “THE CHINESE VIRUS” OR “KUNG FLU”: World Health Organizations publicly rebuked Trump today for referring to COVID-19 as “The Chinese Virus,” warning that this could lead to acts of violence and racial profiling of Chinese people. https://www.cnbc.com/2020/03/18/who-officials-warn-us-president-trump-against-calling-coronavirus-the-chinese-virus.html. Let’s call the White House, and also tell our MoCs to make a public resolution that condemns the racism apparent in that name and urge a consistent protocol in all proceedings, speeches, and contacts with the press to refer to the virus only as “coronavirus” or “COVID-19.”

HEALTHCARE/COVID-19: Health policy experts Suhas Gondi and Abdul El-Sayed have written an op-ed, arguing that the U.S. should utilize the military to adopt a parallel COVID-19 healthcare system. Because the military has extensive experience in building field hospitals and can be deployed rapidly, there is much that could be done to prevent overloading our hospitals and care staff. Let's read through Gondi and El-Sayed's recommendations for how exactly this plan could be executed, then let's get in touch with our federal and state MoC as well as our local government officials, and ask them to consider this option before our healthcare workers are put in the impossible position of deciding who to save when our hospitals and equipment cannot keep up with the influx of COVID-19 patients.

ASK GOVERNOR OF IDAHO TO VETO THE BILL THAT PREVENTS TRANSGENDER PEOPLE FROM CHANGING THEIR BIRTH CERTIFICATES: The Idaho legislature has passed a bill that prevents transgender people from changing their birth certificates. https://www.boisestatepublicradio.org/post/idaho-transgender-birth-certificate-ban-bill-headed-governors-desk#stream/0. In addition to being discriminatory against the transgender community, this bill would likely lead to costly lawsuits. Let’s ask Governor Brad Little 208-334-2100; governor@gov.idaho.gov to veto this bill. 

NO BAILOUTS FOR THE AIRLINE INDUSTRY: The Trump administration is looking at a $1 trillion package to combat corona virus and provide relief for those affected by the pandemic. Let’s tell our MoCs that we want to see our taxpayer money go to working people and small business owners who have lost their livelihood, not to corporations. VOLUNTEERS NEEDED FOR 3D PRINTABLE VENTILATOR PARTS DATABASE: Project Open Air is building an open source database of 3D printable ventilator parts. They are looking for doctors to help catalog needs, engineers and scientist to help design and build parts, and managers to help coordinate the project. THEATERS WORKING ON STREAMING SHOWS DURING SHELTER IN PLACE: Suddenly, the Bay Area institutions’ initiatives to use technology to bring theater to the people, instead of people to the theater, have begun to be emulated nationwide as bans on public gatherings proliferate. DEMAND RELIEF FROM EFFECTS OF CORONAVIRUS PANDEMIC FOR ALL WORKING FAMILIES: The language in the Families First Coronavirus Response Act (HR 6201), recently passed by the House of Representatives, includes provisions for paid emergency medical leave, but it does not apply to people who work for large employers, many of whom are now in difficult situations as schools across the country are starting to close.  https://www.nytimes.com/2020/03/14/us/politics/congress-coronavirus-bill.html and https://www.rollcall.com/2020/03/13/agreement-reached-on-coronavirus-stimulus/ We need to tell our Senators to pass this bill, but also to do more. Let’s tell our Senators to pass HR 6201 immediately and then to do more to make sure that all working families won’t be subject to economic crisis as this pandemic unfolds.   

STOP ALL DEPORTATIONS DURING THE CORONAVIRUS PANDEMIC: While international travel is severely restricted and people are advised to avoid all air travel in order to stop the virus from spreading, people every day are shackled and put on planes to Guatemala, under the bogus “Safe Third Country Agreement.” https://www.npr.org/2020/03/11/814602596/asylum-seekers-reaching-u-s-border-are-being-flown-to-guatemala. Not only is this cruel and illegal, it’s now dangerous to everyone’s health and risks further spreading the virus. CLOSE IMMIGRATION COURTS UNTIL CORONAVIRUS EPIDEMIC HAS PASSED:  While various courts across the country have closed, and even the Supreme Court has postponed oral arguments, Immigration courts are still open, https://www.buzzfeednews.com/article/hamedaleaziz/immigration-court-coronavirus-demand-closed-lawyers-judges, and if an immigrant in a removal case fails to show up for court, they can automatically be deported. This is forcing immigrants and their attorneys to risk the spread of coronavirus for the entire population, which goes directly against CDC recommendations and leaves everyone who works in the court system: attorneys, security guards, officers of the court, judges, as well as the high volume of people in ICE check-in waiting rooms and courtroom waiting rooms especially vulnerable. On the Department of Justice’s Twitter site, it says the immigration court hearings have been postponed, but this is just referring to the master calendar hearing, not the subsequent hearings in which cases are decided. DEMAND CONGRESS NOT REINSTATE THE PATRIOT ACT: Now that the invasive spying provisions authorized by Section 215 of the Patriot Act have gone dark, Mitch McConnell is pushing hard in the Senate to revive them. The Patriot Act created a massive and deeply problematic surveillance infrastructure that law enforcement has repeatedly abused. It’s time for this violation of our privacy to end. We need to make one last push to ensure that our lawmakers do the right thing and let the Patriot Act expire for good. DEMAND THE RELEASE OF ICE DETAINEES TO PROTECT THEM FROM COVID-19:  Acting ICE Director Matthew T. Albence has the power to order the immediate release of all people detained in ICE custody and he must use it NOW. An epidemic like COVID-19 could be devastating to people in crowded detention centers, denied flu shots and already gravely at risk. Social Distancing, the best preventative measure for reducing this pandemic, is impossible in these conditions. ICE must release all people from detention. IMMIGRATION/COVID-19: On February 24th, the Trump administration's public charge rule went into effect, allowing officials to deny green cards to immigrants who may need assistance from federal public benefits such as Medicaid, CHIP and Head Start (https://bit.ly/3d5rlvm). Last Friday, United States Citizenship and Immigration Services (USCIS) announced that they would not consider testing, treatment, and preventative services for COVID-19 as part of the public charge rule (https://hrld.us/39Y5Wm6). Let's make sure to share this information with our local immigrant communities. GUN SALES SOAR DURING CORONAVIRUS OUTBREAK:  “Sales of guns and ammunition are soaring across the US as fears of possible social unrest amid the coronavirus crisis are prompting some Americans to turn to firearms as a form of self-protection. On the west coast, long lines of customers were queueing up outside gun stores to stock up on deadly materials. On Mondays, Rogan’s List features a listing of proposed rule and regulation changes that are currently accepting public comment.  Commenting is the way to show government agencies how we feel about these proposed changes. Our comments also become part of a record that will be reviewed by courts if and when a reg change is contested. Courts use comments to judge whether an agency is acting arbitrarily and capriciously.

SCHOOL LUNCH IN THE TIME OF COVID-19—Low-income, food-insecure students who receive free and reduced-price school meals will be severely impacted as schools close due to the coronavirus emergency.
