On Mondays, Rogan’s List features a listing of proposed rule and regulation changes that are currently accepting public comment.  Commenting is the way to show government agencies how we feel about these proposed changes. Our comments also become part of a record that will be reviewed by courts if and when a reg change is contested. Courts use comments to judge whether an agency is acting arbitrarily and capriciously.

Closing September 16, 2019 URGENT Proposed rule: Medicare and Medicaid Programs: Requirements for Long-Term Care Facilities: Regulatory Provisions to Promote Efficiency, and Transparency https://www.regulations.gov/document?D=CMS-2019-0105-0001 CMS wants to modify nursing home regulations yet again - all but eliminates ombudsman program and other protections. The proposed requirements would rollback numerous resident protections by eliminating or easing up on specific nursing home responsibilities. The result for residents? Reduced standards for safety, quality care and rights. "Here are just a few of the proposal’s lowlights:  Liberalizing the use of dangerous antipsychotic drugs to sedate residents; Making it easier to evict residents by curtailing notice to the ombudsman program; Undermining infection control standards, resident grievances, and dietary management; Cutting facility assessments that align staffing levels with residents’ needs."
